1) INTRODUCTION

1.1. PURPOSE OF POLICY.

Moneta Super complies with Australian Privacy Principles (APPs) outlined in the Privacy Act 1988 (Cth).  This privacy policy explains how Moneta Super manages personal information collected under the Privacy Act 1988 (Cth).  A copy of the Australian Privacy Principles is available on the website of the Office of the Australian Information Commissioner https://www.oaic.gov.au/.  

2) INFORMATION COLLECTION PRACTICES

2.1. WHAT PERSONALLY IDENTIFIABLE INFORMATION DO WE COLLECT?

Depending on your relationship with us, we may collect:

  • Your full name, date and place of birth, addresses, email addresses, and phone numbers.
  • Government-issued identifiers including Tax File Number (TFN), Australian Business Number (ABN), Australian Company Number (ACN), and Director Identification Number (Director ID).
  • Where relevant to the services we provide to you, financial and taxation information such as bank and custodian account details, transaction histories, income and asset details, and tax records.
  • Superannuation-related information including fund and member details, account balances, contributions, pensions, investments, insurance policies, and beneficiary nominations.
  • Employment and professional credentials, including your occupation, qualifications, employment history, visa or work permit status, education, and salary details.
  • Other information from third parties such as banks, financial advisers, insurance brokers, mortgage brokers, and other relevant service providers. This occurs only where permitted under the Australian Privacy Principles (APPs) or where we have obtained your prior consent to receive information from, or disclose information to, these organizations.

When we collect personal information, we will provide clear information about the purpose of the collection and how your information will be used.

2.2. HOW DO WE COLLECT YOUR PERSONAL INFORMATION

We collect information directly from you and indirectly from third parties you authorise, including your adviser, accountant, lawyer, your employer, share registries, custodians, insurers, government agencies (e.g., ATO), and other agencies.

3) USE AND DISCLOSE YOUR INFORMATION

3.1. WHEN WE USE AND DISCLOSE YOUR PERSONAL INFORMATION

In general, we collect, hold, use, and disclose personal information to:

  • Provide SMSF administration and related services you request;
  • Verify identity and maintain accurate records;
  • Communicate with you and respond to queries;
  • Keep you informed about our services and relevant accounting/superannuation industry developments;
  • Administer our business (including surveys/feedback and seminars);
  • Meet legal and regulatory obligations (taxation, superannuation, AML/CTF); and
  • Prevent, detect and investigate fraud or misuse.

With your consent (or as otherwise permitted by law) we may also use your information to personalise your experience and to send service updates or marketing. You can opt out of marketing at any time.

3.2. DISCLOSING YOUR PERSONAL INFORMATION

We may disclose personal information to:

  • Your authorised representatives, such as your financial adviser, accountant, attorney and anyone you explicitly authorise;
  • Professional service and assurance providers, including auditors, actuaries, legal advisers, and other professional service firms;
  • Financial institutions and service providers involved in super fund operations to set up and process transaction;
  • Government agencies and regulators (e.g., ATO, ASIC) where required or permitted by law;
  • IT and cloud service providers, software vendors, data hosts and support personnel who operate our firm’s IT, accounting and administration systems;
  • Our business partners and associated entities that help deliver our services.

We do not sell your personal information.

3.3. CROSS-BORDER DISCLOSURE OF YOUR PERSONAL INFORMATION

We primarily store your personal information in Australia. Some trusted service providers may host or access data from other countries, for example for back-office or IT support. Where this occurs, we take reasonable steps to protect your information, including:

  • Written contracts imposing confidentiality and privacy obligations.
  • Requirements to comply with the APPs or equivalent standards (e.g., ISO 27001) and applicable security controls.
  • Controls over sub-processing, data location, and mandatory breach notification.
  • Access controls, encryption in transit, and secure deletion/return of data at the end of the engagement.
  • Due diligence before onboarding and ongoing reviews of each provider’s security posture.

4) DATA SECURITY 

We use reasonable technical and organisational safeguards to protect personal information from misuse, interference, loss, and unauthorised access, alteration or disclosure.

We destroy or de-identify personal information when your information is no longer required for the purposes for which it was collected, unless we are legally required to retain it.

5) ACCESS AND CORRECTION OF PERSONAL INFORMATION

We take reasonable steps to ensure your personal information is accurate, complete and relevant. You may request access to your personal information we hold or request corrections where it is inaccurate, out-of-date, incomplete, or irrelevant. We will respond your request within a reasonable period. We may need to verify identity and recover reasonable costs of providing access.

If we are unable to provide you with access to your information or make any correction which you have requested, we will explain our reasons. 

To protect your privacy, we may require identification from you before releasing the requested information.
